U.S. Mexico Bar Association Conference: Legalities of Nearshoring

Hone Maxwell LLP Managing Partner Josh Maxwell spoke on a panel at the U.S. Mexico Bar Association’s conference in Austin, Texas on Sept. 22, 2023, titled “Nearshoring: Best Practices to Structure a Manufacturing Operation from a Mexican and U.S. Tax Perspective.” Josh and his fellow panelists gave the audience a full legal picture on the tax consequences and benefits of nearshoring, a strategy of moving part or all a company’s production nearer to its final consumers. The conference covered everything from environmental, labor and security concerns to corporate structuring and taxes.

Given the uptick of nearshoring in recent years and sustained global supply chain issues, the USMBA dedicated its entire annual conference to the trend and its cross-border effects.

When U.S. manufacturers implement nearshoring strategies and relocate production operations from Asia to Mexico to be closer to the U.S. market, they create geographic proximity and other additional benefits. These include efficient supply chain and delivery processes, an affordable and experienced workforce in Mexico, tax advantages and laws protecting a company’s intellectual property.
